Depending on the circumstances, clothing designs and footwear can qualify as works of applied art that enjoy copyright protection.2. The fact that a clothing design produces a distinctive and characteristic effect from an aesthetic point of view in addition to its functional purpose is not sufficient to determine whether it qualifies as a copyrightable work.3. A fashion boot that combines elements of traditional long leather boots and natural rubber boots does not meet the requirement of originality and, therefore, is not protected by copyright law.
