This chapter examines whether the adoption and implementation of policies to deter maritime migration by Australia and other European states constitute crimes against humanity, and the feasibility of the International Criminal Court (ICC) examining the situation. The chapter concludes that, despite the fact that the actions taken by these states may fall under the category of crimes against humanity, the approach of the Office of the Prosecutor and the Court renders it improbable that investigations will be opened.
