Murder on the Dance Floor—The Danish Disco Cartel

In a series of decisions, the Danish Competition Authority has condemned an arrangement between 22 nightclubs involving a non-establishing clause in an otherwise legitimate joint procurement arrangement. According to the Authority, did this qualify as market sharing and a by-object restriction, but this comports badly with EU’s Horizontal Guidelines, generally looking favourable upon joint procurement unless masking a buyer cartel. The case is now pending before the judicial, providing for a case to watch for.
